Effective date: 25/07/2022

  1. Object

For the purposes of this regulation, the terms used with a capital letter have the same meaning as those defined in the general conditions of use of the Platform (the " General Terms ").

The company BEANSTOCK, SAS, with its registered office at 5 avenue du Général de Gaulle, 94610 Saint-Mandé, registered with the RCS of Créteil under number 883 502 197 (" BEANSTOCK "), offers its Customers on the Platform www.beanstock.com a referral program allowing them to refer one or more people who may be interested in the Services offered on the Platform (the " Referral Offer ").

The purpose of this regulation is to establish the terms and conditions under which BEANSTOCK allows Customers of the Platform to benefit from the Referral Offer.

  1. Operation of the referral offer

Access to the referral offer

For the purposes hereof, the term “ Referrer ” means any natural or legal person who has subscribed to and benefited from the Services of the Platform with BEANSTOCK according to the terms specified on the Platform.

The Referrer has the option to refer one or more individuals (the “ Referees ”).

The Referees refer to:

  • any natural person aged at least 18 years, possessing full legal capacity to subscribe to the Services;

  • any legal person acting through a natural person with the authority or power required to contract on behalf of the legal person.

Referral Offer Process

When signing up on the Platform, a referral link (the “Referral Link”) that will provide a unique and personalized code (the “Referral Code”) is made available to the Referrer by any means.

The Referrer must communicate their Referral Link to anyone they wish to refer.

The Referee signs up on the Platform, according to the terms described in the General Conditions; they must provide the Referral Link communicated to them when subscribing for the first time to the Services.

Counterpart of the Sponsorship Offer

For the Referrer

For the first transaction carried out by the Referee, the Referrer benefits from a flat discount whose amount will be communicated by any means and concerns:

  • the transaction fees of BEANSTOCK of the Referrer, or

  • the property management fees of BEANSTOCK, or

  • A pluxee gift voucher (e.g. glady)

In this regard, the Referrer acknowledges and accepts that no discount may be granted on transaction fees or property management fees prior to the effective date indicated above. The discount will be valid for a period of:

  • 1 year regarding the transaction fees,

  • 2 years regarding the property management fees,

  • 1 year regarding the pluxee gift card (e.g. glady).

For the Referee

Each Referee benefits from a discount of 500 (five hundred) euros excluding VAT on the amount:

  • of the transaction fees of BEANSTOCK of the Referee, or

  • of the property management fees of BEANSTOCK.

This discount is implemented in the form of an immediate reduction on BEANSTOCK fees at the time of payment of the first transaction as part of the Services by the Referee. A Referral Code can only be used once. The Referee cannot accumulate multiple Referral Codes.

The Referrer cannot refer themselves. The Referee cannot refer their Referrer in turn.

BEANSTOCK reserves the right to organize occasional Referral Offers whose proposed discount may vary from the Referral Offer presented here.

  1. Terms of the referral offer

Benefit of the discount by the Sponsored

The Referral will only benefit from the discount referred to in the article "Compensation of the Referral Offer" for its first transaction using the Services, whether or not it has previously registered on the Platform.

Any subsequent use of the Services will not result in any discount.

It is specified that the validation of the Referral Offer will only be effective after the 14-day withdrawal period following the registration of the Referral.

Compliance with the sponsorship regulations

The simple act of using the Referral Offer implies a loyal and responsible attitude, as well as compliance with the rules of this referral regulation and the General Conditions, which are included by reference.

Only referrals that comply with the provisions of this regulation will be taken into account for the implementation of the Referral Offer.

Reprehensible behaviors

The Referrer and the Referees agree not to implement or seek to implement any process that would not comply with the principles of this regulation and, more generally, any reprehensible behavior or fraud.

In particular, the following are strictly prohibited:

  • any use of the Services by a Referee with a Referral Code different from the one provided during the initial registration in order to benefit multiple times from the Referral Offer;

  • any exchange, sale, and more generally, any commercial exploitation of the Referral Code.

In case of fraud or non-compliance with this regulation by a Referrer or a Referee, BEANSTOCK may terminate their subscription to the Services, according to the terms provided in the General Conditions. BEANSTOCK also reserves the right to cancel the discounts mentioned in the article "Compensation for the Referral Offer" and to demand the return of the corresponding amounts.

Modification or end of the Sponsorship Offer

BEANSTOCK reserves the right to modify or terminate the Referral Offer at any time. It will inform the Referrers at least 15 days in advance.
In this case, any registration after this date of a Referee on the Platform will no longer entitle them to the discounts mentioned in the article "Counterpart of the Referral Offer".

  1. Litigations and liabilities

BEANSTOCK cannot be held responsible if, in cases of force majeure or justified necessity, it is required to terminate the Sponsorship Offer, or to modify its conditions.

BEANSTOCK may terminate the Sponsorship Offer in particular if it appears that fraud has occurred in any form.

In the event of a dispute regarding the interpretation and execution of this sponsorship regulation, BEANSTOCK will seek an amicable solution to the dispute with the participant(s). In the absence of an amicable settlement, any disputes are under the jurisdiction of the courts.
