The notice of the lease rental
When you make a rental investment, you must afterwards manage the uncertainties of the rental, notably the management of notices.
We present to you two proverbs of our creation on this subject. Any tenant leaving their principal residence is required, after notifying their landlord via LRAR, a bailiff, or delivering in person against receipt, to respect a notice period before being able to officially leave their accommodation. In the same way, any landlord giving notice to their tenant in a principal residence can only retrieve their accommodation after a notice period following official warning. Corollary: the legislation is more lenient in this regard towards the tenant than the landlord. Let's summarize the rules to know.

The notice period starts: The day when the landlord or tenant receives from the other party the registered letter with acknowledgment of receipt requesting the termination of the lease; If applicable, when the bailiff deposits the notice in the mailbox of either party; Or finally at the moment of its hand delivery against receipt or signature. Be aware that the mail may be delayed or returned to the sender. In these two scenarios, the notice period is then postponed based on the actual receipt of the warning.
Until when does the tenant pay their rent? 💶
When the tenant requests the leave, the rent and utility charges are due until the end of the notice period, and this is proportionate to the number of days remaining in the last month. If the landlord agrees to shorten the notice period and finds a new occupant before the end of the period, the tenant ceases to owe rent and utility charges from the date of their successor’s entry. Moreover, the security deposit is not included in the calculation of the amounts owed during the notice period! Please do not mix underwear with socks.
Finally, when it is the landlord who terminates the lease, the tenant can leave the accommodation without notice and pays rent corresponding to the occupancy period.
